Purposes and legal basis for the processing of personal data

Newsletter

For what purposes do we process your personal data?
We process your personal data for marketing purposes, which involves sending you marketing information via e-mail and analyzing whether you read the marketing messages we send and which content interests you the most.

Do you have to provide your data?
Providing your data in the form of an e-mail address is voluntary, but without providing your data we will not be able to send you marketing messages.

On what legal basis do we process your data?
1) Art. 6 section 1 letter f (our legitimate interest) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; GDPR).
2) If you consent to receiving marketing messages to the e-mail address you provided, the legal basis will also be Art. 10 of the Act of 18 July 2002 on the provision of electronic services and Art. 172 of the Act of 16 July 2004 – Telecommunications Law.

Who will we share your data with?
We will transfer your data to suppliers of tools for sending newsletters.

We use MailChimp services to send the newsletter. The operator of this service is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA. MailChimp is a service that allows us, among other things, to organize the sending of the newsletter and its subsequent analysis. The data you provide in connection with your desire to receive the newsletter is saved on MailChimp servers in the USA.

How long will we process your data?
For the duration of our marketing activities, but no longer than until you object to further processing for marketing purposes or withdraw your consent to sending messages to your e-mail address. Your withdrawal of consent does not affect the lawfulness of processing prior to withdrawal.

After providing your data, can you object to its processing?
Yes. You can do this, and when we process your data for direct marketing purposes, you do not have to justify such objection.

Providing personal data is voluntary, but requires the Administrator to take action (provide a response).

Contractors (offers, suppliers, contractors)

The legal basis for processing to the extent necessary to conclude and perform the contract is Art. 6 section 1 letter b of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR) and Art. . 6 section 1 letter c GDPR to the extent necessary for the Administrator to perform his statutory obligations.
The basis for processing is also Art. 6 section 1 letter f GDPR, i.e. the legitimate interest of the Administrator consisting in ensuring the necessary settlements in connection with the concluded contract and pursuing claims.
The data will be processed for the purpose of:
1) concluding and performing the contract concluded with the Administrator and making the necessary settlements in connection with its conclusion – for the time necessary to perform the contract, and after its completion, personal data will be processed for the time needed to demonstrate the correctness of performance of the obligations arising therefrom until the expiry of the deadlines indicated in archiving regulations;
2) performance of the Administrator’s statutory obligations, in particular tax obligations
and reporting – for the time necessary to fulfill the Administrator’s statutory obligations, in particular until the expiry of the limitation period for tax liabilities;
3) implementation of the legally justified interest of the Administrator – for the time necessary to implement the legally justified interest of the Administrator, in this respect, however, no longer than until your objection is deemed justified by the special situation.
Providing data is voluntary, but failure to provide it will result in the inability to conclude a contract.
Your personal data may only be made available to entities authorized to obtain personal data, including the following recipients or categories of recipients:
1) public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for the purposes specified in the law (e.g. ZUS, tax office, police, courts);
2) entities providing specific services to the Company, when the processing of personal data is necessary to perform them (e.g. providers of IT, legal, auditing, accounting services).

Transfer of personal data to a third country (outside the EEA)

In certain cases, we may transfer your personal data in terms of name, surname, department, job position, business e-mail address, telephone number outside the EEA as part of cooperation with clients.

Personal data storage period

Your personal data may be stored for the entire duration of the contract until the limitation period for claims arising therefrom expires, and then the data will be archived for the period specified in the relevant legal provisions.

In connection with the processing of personal data by the Company, you have the following rights:
1) the right to access your data and the right to rectify, delete and limit processing,
2) the right to transfer data,
3) the right to object to processing,
4) the right to withdraw consent to their processing at any time without affecting the lawfulness of the processing carried out on the basis of consent expressed before its withdrawal;
5) the right to lodge a complaint with the President of the Office for Personal Data Protection (Office for Personal Data Protection, ul. Stawki 2, 00 – 193 Warsaw) if you consider that the processing of your personal data violates the provisions of the GDPR.

Job candidates – information regarding the processing of personal data of people applying for employment

The legal basis for the processing of your data to the extent necessary to take actions aimed at conducting the recruitment procedure and concluding a contract is Art. 6 section 1 letter b Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR) and in to the extent necessary for the Administrator to perform his statutory obligations – Art. 6 section 1 letter c GDPR.

To the extent that data is processed on the basis of separate consent, you have the right to withdraw consent at any time. However, this will not affect the lawfulness of data processing carried out before its withdrawal.

Your personal data will be processed until the recruitment process is completed. If a separate consent to data processing for future recruitment purposes is expressed, the data will be processed for 12 months or until the consent to data processing is withdrawn.

You are entitled to:
1) the right to access your data and the right to rectify, delete and limit processing,
2) the right to transfer data,
3) the right to object to processing,
4) the right to withdraw consent to their processing at any time without affecting the lawfulness of the processing carried out on the basis of consent expressed before its withdrawal;

Fanpage Facebook

The personal data administrator processes the data of persons who have subscribed to the EIP Dynamics fan page on the Facebook social networking site by clicking the “Like” or “Follow” icon, published a comment, shared or clicked the “Like” icon under any of the posts posted on the fan page. u, shared any of the materials posted on the fanpage on their profile or sent a private message via the “Send message” function available on the fanpage.

The administrator processes the following categories of data:
– name and surname or nickname of the Facebook user;
– profile picture;
– information provided, e.g. by sending a private message, reactions to posts, content of comments.

Your personal data is processed:
– on the basis of legitimate interest (Article 6(1)(f) of the GDPR) consisting in:
• running a fan page on the Facebook social networking site, under the terms and conditions specified by Facebook, and using it to inform about the administrator’s activity, and to carry out information campaigns regarding the administrator’s activities;
• for the purpose of establishing, pursuing or defending against claims;
• for analytical purposes regarding the functioning, popularity and use of the fan page;
– based on Article. 6 section 1 letter a GDPR, i.e. the data subject has consented to the processing of his or her personal data for one or more specific purposes.

The recipients of your personal data may be:
– authorized administrator’s employees;
– other Facebook users;
– owner of Facebook on the terms available at https://www.facebook.com/about/privacy.

Your personal data may be made available and transferred to authorities, provided that this is required by applicable law.

The data storage period is related to the purposes and basis for their processing:
– data processed on the basis of consent will be processed until the consent is withdrawn;
– data processed on the basis of statutory requirements will be processed for the period in which the law requires data storage;
– data processed on the basis of the legitimate interest of the administrator will be processed until an effective objection is submitted or this interest ceases, e.g. data processed for the purpose of pursuing or defending against claims will be processed for a period equal to the limitation period for these claims.
